Let's be real for anyone like FFRF who apparently doesn't know law.... in this, Clemson is the defendant. ...FFRF is attempting to be a plaintiff. Isn't it the plaintiff's job to show the beyond reasonable doubt facts or did Elliot misconstrue that too? Why does Clemson need to prove anything?

Yeah, I think they know that and are trying to bait Clemson's counsel into spilling more facts so that they (meaning FFRF) can go on a further fishing expedition with those facts. But Clemson's legal counsel knows that and isn't taking the bait. I also think FFRF is taking advantage of the fact that much of the public doesn't understand the dynamic you pointed out, and they'll think it's only reasonable for Clemson to discuss it further.
The part of the law FFRF has a problem grasping isn't burdens of proof in a general sense, is the establishment clause in particular. They're clueless. Absolutely clueless.

Why should the majority have to BOW down to the minority. That is exactly what the FFRF is, a minority. They are seeking publicity, as well as, in the long run financial gain for their group. Their legal staff contradicted themselves 2 different times in their original complaint and Clemson University answered their allegations in their response. Ignore them.

Another interesting aspect concerning this complaint is that the FFRF doesn't have a victim or complainant. Heck, you could offer free ice cream to 100 people and you probably would have at least 5 complain. Where is the victim? I agree that we should leave the situation as is and not respond further to the FFRF.

Number 1, it was a response.
Number 2, it was a short response which subtly says you don't deserve a long response as attorneys usually respond to frivolous legal claims. Clemson is not about to give them the satisfaction of a long defensive legal argument and/or justification of its actions.
Number 3, it also served to #### off and call FFRF's bluff about the matter by simply stating they "misconstrued facts" and stating nothing more. FFRF wants to argue their complaint in the press. Clemson is saying we will argue the facts elsewhere (i.e., a court of law).
Well done Clemson.

I'm sure it is. FFRF achieves its goals by getting organizations to cave due to publicity and not wanting distractions. Any organization with the spine to stand up to them will kick them in their teeth. Groups like the ACLJ, Beckett Fund, and the Alliance Defending Freedom just drool at the prospects of getting these sniveling little whiners in a courtroom.
